Tongaat - notice to shareholders
The Company and the joint Business Rescue Practitioners of the Company were granted leave to appeal ("the appeal") by the Supreme Court of Appeal ("SCA") in Bloemfontein against the judgment of Honourable Judge Vahed dated 4 December 2023 in the High Court of South Africa, KwaZulu Natal Local Division, Durban under case number D4472/2023 ("the declarator application"). The appeal was heard by the SCA on 12 November 2025.
The SCA's judgment was handed down on 15 December 2025, which dismissed the appeal. A copy of the declarator application, the notice of appeal and the SCA's judgment as referred to above is available on the Company's website at www.tongaat.com/business-rescue/. The BRPs, together with their legal advisers, are studying the SCA's judgment and will consider its implications for the business rescue proceedings and determine any further steps. Further updates will be provided in due course.
